Private sewers and lateral drains to be adopted by water companies in October 2011

The Water Industry (Schemes for Adoption of Private Sewers) Regulations 2011 came into force on 1 July 2011. The effect of these Regulations is that the majority of existing private sewers and lateral drains will be adopted by water companies. For the most part, these reforms are welcome and remove a cumbersome burden on property owners. However, landowners (particularly those wishing to sell land to developers) should take care not to inadvertently lose valuable rights.

What price a footpath?

But there was an argument following the closure of the network during the Foot and Mouth Disease outbreak in 2001 that the value of footpaths to the rural economy was vastly underestimated. Now, with the network fully open for business, recent research quoted by the Ramblers claims that around £7.3bn was spent on visits to the countryside last year.

A reference…? "No comment"

Save for certain regulated roles, there is no obligation to provide an employee with a reference. However, where one is provided care must be taken to ensure it is both accurate and non-discriminatory. It is well established that an employer can be liable to a former employee for a discriminatory reference, as well as one that has been prepared negligently. Equally, it is possible for an individual's new employer to sue the former employer for negligence where an employee does not live up to the reference that has been provided.

First Corporate Manslaughter Prosecution

The first prosecution under the new Corporate Manslaughter Act is shortly to take place. Cotswold Geotechnical Holdings Ltd is the first UK company to be charged with corporate manslaughter following the death of an employee on 5 September 2008. The junior geologist was taking soil samples from inside a pit when it collapsed on top of him. A post-mortem revealed that he had suffocated in the mud. The company faces a separate charge under the Health and Safety at Work Act and a company director has been charged with individual manslaughter by gross negligence and a health and safety offence.
